第二十一條 中國(guó)人民銀行設(shè)立人民幣發(fā)行庫，在其分支機(jī)構(gòu)設(shè)立分支庫。

Article 21 The People's Bank of China shall establish a Renminbi issue treasury and shall establish subsidiary issue treasuries at its branches.

分支庫調(diào)撥人民幣發(fā)行基金，應(yīng)當(dāng)按照上級(jí)庫的調(diào)撥命令辦理。

The subsidiary issue treasuries shall, in allocating Renminbi issue fund, act on the order of allocation from their superior treasury.

任何單位和個(gè)人不得違反規(guī)定，動(dòng)用發(fā)行基金。

No units or individuals may use the issue fund in violation of regulations.

第二十二條 中國(guó)人民銀行為執(zhí)行貨幣政策，可以運(yùn)用下列貨幣政策工具：

Article 22 To implement monetary policies, The People's Bank of China may apply the following monetary policy instruments:

(一)要求金融機(jī)構(gòu)按照規(guī)定的比例交存存款準(zhǔn)備金;

(1)to require a banking institution to place a deposit reserve at a prescribed ratio;

(二)確定中央銀行基準(zhǔn)利率;

(2)to fix the base interest rates for the central bank;

(三)為在中國(guó)人民銀行開立帳戶的金融機(jī)構(gòu)辦理再貼現(xiàn);

(3)to handle rediscount for baking Institutions that have opened accounts in The People's Bank of China;

(四)向商業(yè)銀行提供貸款;

(4)to provide loans for commercial banks;

(五)在公開市場(chǎng)上買賣國(guó)債和其他政府債券及外匯;

(5)to deal in State bonds and other government bonds and foreign exchange on the open market; and

(六)國(guó)務(wù)院確定的其他貨幣政策工具。

(6)other monetary policy instrument decided by the State Council.

中國(guó)人民銀行為執(zhí)行貨幣政策，運(yùn)用前款所列貨幣政策工具時(shí)，可以規(guī)定具體的條件和程序。

When applying the monetary policy instruments listed in the preceding paragraph to implement monetary policies, The People's Bank of China may work out specific requirements and procedures.

第二十三條 中國(guó)人民銀行依照法律、行政法規(guī)的規(guī)定經(jīng)理國(guó)庫。

Article 23 The People's Bank of China shall manage the State treasury in accordance with laws and administrative rules and regulations.

第二十四條 中國(guó)人民銀行可以代理國(guó)務(wù)院財(cái)政部門向各金融機(jī)構(gòu)組織發(fā)行、兌付國(guó)債和其他政府債券。

Article 24 The People's Bank of China may, on behalf of the financial department under the State Council, issue to banking institutions, and honour State bonds and other government bonds.

第二十五條 中國(guó)人民銀行可以根據(jù)需要，為金融機(jī)構(gòu)開立帳戶，但不得對(duì)金融機(jī)構(gòu)的帳戶透支。

Article 25 The People's Bank of China may open accounts for banking institution as needed, but may not allow them to overdraw.

第二十六條 中國(guó)人民銀行應(yīng)當(dāng)組織或者協(xié)助組織金融機(jī)構(gòu)相互之間的清算系統(tǒng)，協(xié)調(diào)金融機(jī)構(gòu)相互之間的清算事項(xiàng)，提供清算服務(wù)。具體辦法由中國(guó)人民銀行規(guī)定。

Article 26 The People's Bank of China shall organize or assist in organizing a clearing system among banking institutions, coordinate the efforts of the financial institutions in matters of clearing and provide services in this regard. The specific measures therefor shall be formulated by The People's Bank of China.

第二十七條 中國(guó)人民銀行根據(jù)執(zhí)行貨幣政策的需要，可以決定對(duì)商業(yè)銀行貸款的數(shù)額、期限、利率和方式，但貸款的期限不得超過一年。

Article 27 The People's Bank of China may, as required by the implementation of monetary policies, determine the amounts, term, interest rates and forms of loans extended to commercial banks, however, the maximum term of loans shall not exceed one year.

第二十八條 中國(guó)人民銀行不得對(duì)政府財(cái)政透支，不得直接認(rèn)購、包銷國(guó)債和其他政府債券。

Article 28 The People's Bank of China may not make an overdraft for the government, and may not directly subscribe or underwrite State bonds or other government bonds.

第二十九條 中國(guó)人民銀行不得向地方政府、各級(jí)政府部門提供貸款，不得向非銀行金融機(jī)構(gòu)以及其他單位和個(gè)人提供貸款，但國(guó)務(wù)院決定中國(guó)人民銀行可以向特定的非銀行金融機(jī)構(gòu)提供貸款的除外。

Article 29 The People's Bank of China may not provide loans to the local governments or government departments at various levels, to non-banking institutions, other units or individuals, with the exception of the specific non-banking institutions as decided by the State Council.

中國(guó)人民銀行不得向任何單位和個(gè)人提供擔(dān)保。

The People's Bank of China may not provide guaranty for any unit or individual.

第三十條 中國(guó)人民銀行依法對(duì)金融機(jī)構(gòu)及其業(yè)務(wù)實(shí)施監(jiān)督管理，維護(hù)金融業(yè)的合法、穩(wěn)健運(yùn)行。

Article 30 The People's Bank of China shall, in accordance with law, exercise supervision and control over banking institutions and their business operations to maintain the legitimate, stable and sound operation of the banking industry.
